Regulators levied penalties against TWA, now owned by AMR Corp., and ordered a $30 million cleanup after discovering contamination at the site in the 1980s. The insurers said they were sued in 1994, with TWA claiming the pollution was accidental and therefore covered by their policies with Lloyds, London and others.

The Missouri Court of Appeals upheld a lower court's ruling that the pollution was deliberate and not covered, the lawyers said.

The insurers were represented by Gary W. Westerberg of Lord, Bissell & Brook in Chicago and by Joe B. Whisler of Cooling & Herbers in Kansas City.
