EU Court Rejects Polish Call for Carbon Cut Delay

BELGIUM: November 13, 2007


BRUSSELS - A European Union court has rejected Poland's request for a temporary suspension of a cut, set by the bloc, in the country's carbon dioxide emission limits, the court said on Monday.


Poland has filed a lawsuit against the executive European Commission over its decision to cut by 27 percent the country's proposed annual carbon dioxide emissions cap for 2008-2012.

Warsaw argues Poland's economy will suffer irreparable damage from the cut.

Poland also asked the Luxembourg-based European Court of First Instance to suspend the Commission's decision until the case is concluded, which may take months if not years.

"The motion for a temporary measure has been dismissed," the court said in a statement.

The Commission has proposed the cuts for Poland and other countries to try to shore up the emissions trading scheme, the EU's key tool to curb global warming and meet commitments under the Kyoto Protocol. (Reporting by Marcin Grajewski, editing by Anthony Barker)
